Special Economic Zone (KEK)

KEK (Special Economic Zone) is a designated area within the jurisdiction of Indonesia established to support specific economic activities while benefiting from special facilities and incentives provided by the government. Its legal basis is governed by Law No. 39 of 2009 on Special Economic Zones, as amended by the Job Creation Law, and Government Regulation No. 40 of 2021 on the Administration of Special Economic Zones. The primary objectives of establishing SEZs are to attract domestic and foreign investment, stimulate regional economic growth, create employment opportunities, and enhance the competitiveness of Indonesia's national industries. Depending on their designated functions, Special Economic Zones may focus on manufacturing, logistics, tourism, digital economy, healthcare, education, energy, or technology development. Their governance is overseen by the National Council for Special Economic Zones, Regional Councils, SEZ Administrators, and the Business Entities responsible for developing and managing each SEZ.

Businesses operating within a Special Economic Zone are entitled to a wide range of incentives, including tax facilities such as tax holidays and tax allowances, exemptions from import duties and import VAT, simplified business licensing processed through the OSS (Online Single Submission) system by the SEZ Administrator, as well as regulatory conveniences related to employment, immigration, and land administration. To establish operations within an SEZ, a business entity must submit an application to the SEZ Administrator, accompanied by corporate legal documents, a business activity plan, and proof of land rights or land utilization within the designated zone. Once approved, the company is officially recognized as an SEZ business operator and becomes eligible to enjoy all available incentives and facilities. Through this framework, Special Economic Zones serve as a strategic government instrument to accelerate equitable economic development, promote industrial downstreaming, and strengthen regional and national industrial supply chains.
